As we have entered a new month, we want to provide you with an update on court operations.

Late last night, the Presiding Judge of Santa Clara County issued an emergency order closing all Santa Clara County Courts today. This order is in response to the San Jose curfew in place this week. We are unsure if this closure will last the duration of the curfew (7 days or until further notice), or if it is only for one day. As we learn more information, we will pass that on to you.

It is our understanding that this Friday, a new shelter in place order shall issue lifting more restrictions upon residents of Santa Clara County. Our understanding is that the court is taking a tailored approach to reopening the courts (as it applies to COVID and social distancing). We will keep you informed of how these procedures impact your cases individually and any upcoming hearings you may have. Based on the court’s information so far, we do not anticipate that the court will return to full operational capacity until late July or early August.

To provide some additional information, per the family code, the court is prioritizing cases in the following order:

1. Domestic violence with children
2. Domestic violence without children
3. Custody/Visitation matters
4. Child and spousal support (DCSS is hearing some cases separately)
5. Any hearings that have been continued but are on a subject matter not listed above, we are working diligently to obtain the status of the continued hearings. Some matters are being continued to status conferences only, while others shall be substantive hearings.
6. Settlement negotiations are still possible to be ongoing.
7. Property issues, including the processing of judgments, are the lowest priority for the court right now

We are also prioritizing cases in the same order as directed by the court.
